Conduct: On 26 May 2020, Colin Harston (“Mr Harston”) caused Online Digital Services Limited (“ODS) to breach the terms and conditions of the bounce back loan (‘BBL’) scheme by applying for a second BBL that he knew or ought to have known that ODS was not entitled to, having previously caused ODS to apply for and receive a BBL of £50,000 on 14 May 2020, in that: • Under the terms of the BBL scheme, a business was entitled to apply for one BBL of up to a maximum of £50,000. • On 14 May 2020, Mr Harston submitted a BBL application to Bank A on behalf of ODS, requesting a BBL of £50,000 and the BBL funds of £50,000 were paid into ODS’ bank account on the same day. • On 26 May 2020, Mr Harston made a second BBL application on behalf of ODS to Bank B for a BBL of £50,000. The BBL funds of £50,000 were paid into ODS’ bank account on 29 May 2020. • The application form submitted to Bank B on 26 May 2020 was signed by Mr Harston and included a declaration confirming that this was the only BBL application made for this business. • On 24 July 2024, when ODS went into liquidation there were outstanding balances of £54,074 and £50,737 owed to Bank A and Bank B respectively.
