Conduct: Mr Ming Chun Ling (“Mr Ling”) failed in his duty to comply with the provisions of the Immigration, Asylum and Nationality Act 2006 causing Superstar Takeaway Ltd (“Superstar”) to breach section 15 of the Act. This resulted in a fine of £45,000, which remained unpaid at liquidation. In that: • Following their investigation, the Home Office found the company liable for employing three workers in breach of section 15 of the Immigration, Asylum and Nationality Act 2006. The Civil Penalty Calculator was applied to the case, with a starting point of £15,000 per worker. • The Home Office issued the company with a Civil Penalty Notice on 03 May 2022 for a £45,000 fine. • The Home Office provided evidence to show that illegal workers were employed by Superstar under a contract and caried out work for which they did not have permission to undertake. • Mr Ling was the sole director of Superstar and the person with responsibility for ensuring the legislation was adhered to and appropriate employment checks were carried out. • There were no mitigating factors and therefore the full penalty was calculated to be £45,000. • No payments were made towards the Home Office fine and the amount of £45,000 remained outstanding at the date of Liquidation.
