Conduct: Mr James Newton – Browne (“Mr Newton – Browne”), caused Occupation Navigation Ltd (“Occupation”) to apply for a Bounce Back Loan (“BBL”) of £50,000, to which Occupation was not eligible: Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure required was that of the calendar year 2019 or where a business was established after 1 January 2019 their estimated turnover, provided they were established and operating by that date. Occupation was incorporated on 3 June 2019 and Mr Newton – Browne has been the sole director throughout. Mr Newton - Browne applied for a BBL of £50,000 on behalf of Occupation. The company bank statements from November 2019 show the company had no turnover. Similarly, there is no turnover shown in the June 2020 accounts. Occupation received a BBL of £50,000 on 05 June 2020. The company declared its forecasted turnover as £220,000 However, no documentation has been provided to support how this figure was reached. There is no evidence from the records that the director was actively involved in corporate events. Trade for the first 12 months relate to book sales only which do not appear to have generated any income. Payments totalling £3,304 have been made in respect of the BBL. Total liabilities at liquidation are £46,695.68 which is the outstanding amount owed for the BBL.
