Conduct: On 24 September 2020, Muhammad Gohar (“Mr Gohar”) caused Chicken Palace Wasall Limited (“Chicken Palace”) to apply for a Bounce Back Loan (“BBL”) of £50,000 using an overstated turnover figure, which resulted in Chicken Palace obtaining a BBL of more than it was entitled to. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover. • Chicken Palace was incorporated on 24 May 2019 and as such was entitled to estimate its turnover. • On 24 September 2020, Mr Gohar applied for a BBL of £50,000 on behalf of Chicken Palace declaring its estimated turnover as £250,000. • Chicken Palace’s bank statements show that from 09 August 2019 (the date on which trading income was first received) until 09 August 2020, receipts totalled £36,835. • On the basis of the income shown in the bank statements, the estimated turnover of £250,000 was overstated and the maximum BBL to which Chicken Palace was entitled would have been £9,209. • Chicken Palace received the BBL funds of £50,000 on 15 October 2020. • Total liabilities at liquidation amount to £58,268 of which £46,582 relates to the amount owed in respect of the BBL, with repayments made totalling £6,067.
