Conduct: On the 05 May 2020 Sebastien Potts ( Mr Potts) caused Meunier Services Ltd (hereinafter referred to as “Meunier”) to obtain a Government Backed Covid-19 Bounce Back Loan (hereinafter referred to as “BBL”) of £45,000, to which it was not entitled, and failed to use it in its entirety for the economic benefit of Meunier, in that: • A review of the bank statement shows that Meunier received income for the last time on 27 January 2020. • On 05 May 2020, the sum of £45,000 was paid into Meunier’s bank account, being the BBL. Following the receipt of the loan, the account balance stood at £45,484.12 in credit; • On the same day, Mr Potts transferred the sum of £40,000 into a connected party’s bank account; • Between 05 May 2020 and 16 March 2021, £471.30 was paid out of Meunier’s bank account for what appears to be business expenses. During the same period, net payments of £1,538.52 were made into Mr Potts’s personal bank account; • A payment of £3,484 was made on 01 February 2021 to an Insolvency Practitioner to cover the fees of Meunier’s liquidation. • On 16 March 2021, Meunier entered liquidation with liabilities totalling £45,000 being the BBL. On the same date, the bank account balance was £9.70 in debit.
