Conduct: Neil Malcolm Cropper (“Mr Cropper”) failed to ensure that NC Hospitality Management Limited (“NCHML”) complied with its statutory obligations to submit payments to HM Revenue & Customs (“HMRC”) as and when due and caused NCHML to trade to the detriment of HMRC in relation to Value Added Tax (“VAT”), from at least 07 January 2020 to liquidation. This has resulted in liabilities of at least £271,565 due under VAT. In that: • VAT Liabilities totalling £300,257 remains outstanding for the period 07 January 2020 to 19 December 2023. This sum includes five assessments made by HMRC totalling £88,817 and surcharges totalling £19,881. • NCHML made no payments towards VAT labilities between 07 January 2020 to 19 December 2023. Comparative treatment • At the date of Liquidation HMRC was the Company’s largest creditor with a claim totalling £333,635 out of liabilities totalling £387,246. At this date trade creditors stood at £53,610. • A review of the Company Bank Statements has been conducted for the period 07 January 2020 to 19 December 2023 (date of Liquidation) which shows receipts of £1,952,464.46 and payments outgoing of £1,961,385.40 which includes the following: o Employee’s - £515,692.28 o Trade and Expense - £880,170.91 o Transfers - £28,310.00 o Vehicles – £1,995.68 o Unknown/Unknown Individuals - £73,766.49 o Director/Personal - £163,929.39 o Finance - £18,900.38 o Associated Company - £239,771.54 o HMRC - £14,100.10 • During the period the HMRC VAT liability increased from £82,070 to £274,539.15 as of 31 May 2021 to the date of liquidation. • From the Company Accounts dated year ending 31 May 2021 the trade creditor position has increased from £11,050 to £53,610 as at the date of liquidation.
