Conduct: Ms Rusin breached the terms of the Bounce Back Loan ("BBL") Scheme by causing Margaret Property to overstate its turnover on its application for a BBL resulting in the company receiving a BBL of £50,000, when she knew, or ought to have known, was more than it was entitled to, in that: 8.1 Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019 the 25% limit was to be applied to the estimated turnover from the date the business started. 8.2 Margaret Property was incorporated on 29 April 2019 and based on the Company bank statements started trading from at least 20 May 2019 so was eligible to use an estimated turnover from the date the business started. 8.3 On 30 May 2020, Ms Rusin applied for a BBL of £50,000 on behalf of Margaret Property declaring an estimated annual turnover of £270,000, and consequently on 02 June 2020 the company received a £50,000 BBL, the maximum loan amount possible under the BBL scheme. 8.4 The company's bank statements show that between 20 May 2019 and the date of the BBL application on the 30 May 2020, the company received credits totalling £14,140. 8.5 When Margaret Property entered liquidation on 09 May 2022 it declared liabilities of £51,800, including the £50,000 BBL. 8.6 The bank claimed £50,277.79 in the liquidation in respect of the BBL.
