Conduct: In June 2020, Sherko Ghaderi (“Mr Ghaderi”) caused Electrical and Electronic Solutions (EES) Ltd (“EES”) to apply for and obtain a £50,000 Government backed Bounce Back Loan (“BBL”) which was a higher amount than the company was entitled to, by providing information to the lender that he knew, or ought to have known was inaccurate. In that: Under the terms of the BBL scheme, businesses could borrow 25% of the company turnover for 2019, between £2,000 and £50,000 up to a maximum of £50,000 or if incorporated after 1 January 2019 its estimated annual turnover from the date the business started. EES was incorporated and commenced to trade in April 2019 so the relevant period was April 2019 to April 2020. EES applied for a £50,000 BBL on 04 June 2020 and the funds were paid into the company bank account on 05 June 2020. In the BBL application form signed by Mr Ghaderi and dated 04 June 2020, the company’s turnover was stated to be £200,000. Full accounts made up to 30 April 2020 show that the turnover for that period was £46,250. EES therefore received a higher BBL than the company was entitled to. At liquidation on 06 July 2021 £42,000 of the BBL remained outstanding.
