Conduct: On 17 June 2020, Mr Henry Smith (“Mr Smith”) caused H Smith Furniture Supplies Ltd (“Furniture”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by overestimating its turnover on the BBL application, resulting in Furniture receiving more funds than it was entitled to from the BBL scheme. In that: • A company that was trading at 01 March 2020 was eligible for a BBL of 25% of its actual turnover in the calendar year 2019 or, if it commenced trading after 01 January 2019, 25% of its estimated annual turnover from the date the business was started; • Furniture was incorporated on 26 April 2019 and commenced trading on 01 May 2019. Accordingly, Furniture was eligible to apply for a BBL based on estimated annual turnover. • Between 01 May 2019 and 30 April 2020, Mr Smith raised sales invoices to a total value of £40,519 which were issued by Furniture. In the same period, £56,326.15 was paid into Furniture’s bank account; • On 17 June 2020, Mr Smith applied to Furniture’s bank for a BBL of £50,000, declaring estimated turnover of £250,000; • On 25 April 2021, Mr Smith approved Furniture’s accounts for the year ended 30 April 2020 which showed turnover of £60,519; • The maximum BBL to which Furniture was entitled was £15,130; • Furniture received the BBL of £50,000 into its bank account on 18 June 2020 which was £34,870 more than it was entitled to. • Mr Smith failed to provide evidence to support the estimated turnover figure declared in the BBL application • Between 19 July 2021 and 18 May 2022, Furniture made 11 repayments totalling £6,180.74 in respect of the BBL. • Furniture entered creditors voluntary liquidation on 26 August 2022. The bank was the sole creditor in the liquidation in the amount of £45,187.66 relating to the BBL.
