Conduct: Mubasher Sajad (“Mr Sajad”) caused Mubasher Sajad Healthcare Ltd (“Healthcare”), to breach the conditions of the Bounce Back Loan (“BBL”) scheme by overstating the company’s annual turnover to obtain a BBL of £50,000 on 3 June 2020, when he knew or ought to have known that Healthcare was not eligible for a loan of that amount and thereafter the BBL was not used for the economic benefit of the business. In that: a. The BBL scheme allowed businesses affected by the Coronavirus pandemic to apply for a BBL of between £2,000 and £50,000, up to a maximum of 25% of turnover in the calendar year 2019 or if established after 1 January 2019 its estimated turnover from the date the business started. b. To receive a BBL of £50,000 a declared turnover of at least £200,000 was required. c. Draft accounts for the period from 20 April 2019 to 30 April 2020 list Healthcare’s turnover at £45,649. d. Available bank statements list sales income between 22 May 2019 and 21 May 2020 of £49,805. e. On 2 June 2020 Mr Sajad made an online BBL application for £50,000 and on 3 June 2020 the £50,000 BBL was credited to Healthcare’s bank account. f. Between 20 July 2019 and 23 July 2020 payments totalling £50,000 were made to a building company in Scotland, which was not for the economic benefit of Healthcare.
