Conduct: Mr Ashley Andrew Stockton ("Mr Stockton") caused Truth Nightclub Ltd ("TNL") to make a false declaration when applying for and obtaining two Government backed Bounce Back Loans ("BBL") for a total of £70,000 contrary to the terms of the BBL scheme. In that: TNL was incorporated on 13 April 2019. The BBL Scheme allowed businesses to apply for one BBL of between £2,000 and £50,000. A company could obtain up to 25% of its turnover for the calendar year 2019. TNL was permitted to estimate its turnover as it was established after 1 January 2019. TNL applied for a £45,000 BBL with Bank A on 4 May 2020 declaring turnover for the 2019 calendar year of £200,000. The Bank A BBL was received on 7 May 2020. TNL applied for a £25,000 BBL with Bank B on 16 May 2020 declaring turnover for the 2019 calendar year of £150,000. The Bank B BBL was received on 18 May 2020. Both the Bank A and Bank B BBL applications were made by Mr Stockton. The second BBL application with Bank B contained a declaration that the application was TNL’s only application for a BBL. When making the application for the second BBL, Mr Stockton falsely declared that the second BBL application was TNL's only application for a BBL. In addition to the 2 successful BBL applications Mr Stockton applied to Bank B for a further 2 “top-ups “ on 10 November 2020 for £25,000 and on 27 November 2020 for £12,500, neither of the 2 top up applications were accepted, Mr Stockton therefore attempted to obtain further funds from Bank B to which TNL was also not entitled. At liquidation, no repayments had been made towards either BBL obtained.
