Conduct: Kieran Clarke (“Mr Clarke”) made a wrongful declaration on a Bounce Back Loan (“BBL”) application for KJC Logistics Ltd (“KJC”), by overestimating KJC’s turnover. As a result, KJC received BBL funds of £49,550, that it was not entitled to. Mr Clarke also caused KJC to expend £48,909.48 of the BBL funds for purposes that did not provide economic benefit to KJC, in breach of the BBL terms and conditions.?In that: ?? Under the BBL scheme, businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of its turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019, or where a business was established after 01 January 2019 it was their estimated turnover for the 12 months after the business started.?? ? KJC was incorporated on 11 April 2019 and commenced trading on such day. Accounts for the financial year ending 30 April 2020 confirm turnover of £2,301, and based on this turnover, KJC was not eligible for a BBL. ? Mr Clarke applied for a BBL of £49,550 on behalf of KJC. To obtain a BBL of £49,550, Mr Clarke had to declare that KJC’s turnover was at least £198,200. KJC received the BBL funds of £49,550 on 12 January 2021 into its bank account. ? Between 12 January 2021 and 10 February 2021, payments were made to a connected company totalling £14,900, and payments were made to financial institutions totalling £34,009.48 which were not for the economic benefit of KJC. ? Total liabilities at liquidation amount to £61,918 of which £49,000 relates to the amount owed in respect of the BBL.?
