Conduct: Robert Daniel Mead (“Mr Mead”) caused RMD Investments Ltd (“RMD”) to act in breach of the terms of the government-backed “bounce back loan” (“BBL”) scheme by obtaining a second BBL of £50,000 when the lending criteria was one loan only and further that some of the funds from the second loan were misused in that they were not used entirely for the economic benefit of the company, in that: The conditions of the BBL scheme provided that a business was eligible for one loan to a maximum of £50,000. Mr Mead applied for a BBL with loan provider one and received £50,000 on 15 June 2020. On 12 June 2020 Mr Mead applied for a second BBL of £50,000 with loan provider two and signed the declaration confirming that that it was the only application for a BBL for the business. The BBL of £50,000 was paid by loan provider two into a current account that was opened to receive these funds on 30 July 2020. Mr Mead has stated that he applied for the second loan due to a delay in receiving the first loan, however he did not repay either of the loans The funds from the second BBL paid into the bank account on 30 July 2020 were not used in full for the economic benefit of the company. Payments were made to and from an investment trading platform, of which net payments of £6,659 were not expenditure related to the company’s trading and were not for the economic benefit of the company as per the requirements of BBL scheme . By the date of liquidation the creditors totalled £166,688 of which £100,000 was owed to banks under the BBL, £39,688 was owed to Mr Mead and £27,000 was owed to investors.
