Conduct: On 22 August 2020, Nadine Naily (“Ms Naily”) caused Neish Group Limited (“Neish Group”) to breach the terms and conditions of the Bounce Back Loan ("BBL") scheme by applying for a BBL of £50,000 when she knew or ought to have known that Neish Group was not entitled to the loan. In that: ? • Under the BBL scheme, businesses were able to apply for up to 25% of their turnover to a maximum of £50,000. In order to apply, borrowers were required to declare, amongst other things, that the business was engaged in trading or commercial activity in the UK at the date of the application, and was carrying on business on 1 March 2020, and had been adversely affected by coronavirus (COVID-19). • Ms Naily made an application for a £50,000 BBL on behalf of Neish Group on 22 August 2020. The BBL funds were paid into Neish Group’s bank account on 24 August 2020.??? • Ms Naily submitted the BBL application form on 22 August 2020 when she knew or ought to have known that Neish Group was not eligible for the BBL scheme as it had been neither carrying on business on 01 March 2020 nor engaged in trading or commercial activity at the time of the application. • A review of an Account Opening Form provided by the Bank, show Ms Naily applied to open a business current account for Neish Group on 07 August 2020. • Analysis of bank statements provided by the bank, show that the first transaction on Neish Group’s bank account was a £180 payment from a connected company on 20 August 2020, and the second transaction in the bank account was the receipt of the £50,000 BBL on 24 August 2020. • Accounts filed at Companies House for the accounting year ending 30 April 2020 show Neish Group was a dormant company. • Neish Group entered liquidation with liabilities totalling £53,175 of which £50,000 relates to amounts owed in respect of the BBL.
