Conduct: On 10 June 2020 Miss Toni Louise Baldey (‘Miss Baldey’) applied for and obtained a government-backed Bounce Back Loan (‘BBL’) of £50,000 for Chase Construction Consultancy Ltd (‘CCC’) when she knew or ought to have known that CCC’s annual turnover would have entitled CCC to a maximum BBL of £33,129. Furthermore, at least £42,013 of the proceeds of the loan were paid to a third party and were not used for the economic benefit of the business as required under the terms of the BBL scheme. In that: Obtaining a BBL • The BBL scheme permitted a loan of up to 25% of a business’ turnover in the calendar year 2019 (or estimated annual turnover from the date it commenced trading if it had been established after 01 January 2019), from £2,000 to a maximum of £50,000; • CCC was incorporated in March 2019 and commenced trading at that time; • Accounts prepared for CCC’s first year of trading, to 30 April 2020 show turnover of £132,516; • Bank statements for the period March 2019 to 30 April 2020 show income comparable to that stated in the accounts. • As CCC was established after 01 January 2019 it was permitted to estimate its annual income for the BBL application, however as its annual income was known, this figure should have been declared on the application form; • On 10 June 2020 Miss Baldey completed an application form for a BBL from CCC’s bank, self-certifying that its turnover/estimated annual turnover was £200,000 and requesting a loan of £50,000. • Therefore, CCC obtained £16,871 in BBL funding to which it was not entitled. Disbursal of the BBL • The terms of the BBL scheme required the proceeds to be used solely for the economic benefit of the business; • Immediately before the receipt of the BBL the bank account balance was £78 cr; • On 11 June 2020 the BBL was paid into CCC’s account; • Following this, payments totalling £50,000 were made to a third party between 13 and 25 June 2020 and these were not for the economic benefit of the Company’s business; • Income of £7,909 was received in this period and therefore £42,013 of the above payments could not have been funded without the BBL; • The bank has claimed £43,031 under the Government guarantee.
