Conduct: On 22 June 2020, Mr Paul McGrath (‘Mr McGrath’) provided inaccurate information in a Bounce Back Loan (“BBL”) application made on behalf of Jaeger Recruitment Ltd (“Jaeger”), by using a turnover figure that he knew or ought to have known was an unreasonable estimate. As a result, Jaeger received BBL funds of £41,500, which was more than it was entitled to. In that:    • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it was their estimated turnover for the 12 months from when the business started.   • Jaeger was incorporated on 23 March 2019 and began trading in September 2019.  • On 22 June 2020, Mr McGrath applied for a BBL of £41,500 on behalf of Jaeger declaring that Jaegers relevant turnover was £198,000.  • Company bank statements show receipts of £46,547 between 23 September 2019 and 22 June 2020 which, if extrapolated, indicate an annual turnover of £62,062 • Accounts for the Y/E 31 March 2020 show turnover of £41,146. • Based on the higher figure of £62,062 the company would have been entitled to a maximum BBL of £15,516. Therefore, it obtained £25,984 more than it was entitled to have. • Total liabilities at liquidation amount to £194,204 of which £37,219 relates to the amount owed in respect of the BBL. Repayments totalling £4,281 have been made toward the BBL.
