Conduct: Mr Narcis-Iosif Chiriac (“Mr Chiriac”) breached his duties as a director of Cherry Tree 4 You Ltd (“Cherry Tree”) trading as Cherry Tree Hand Car Wash by failing to ensure that it complied with legislative requirements, in that: • Cherry Tree did not comply with its statutory obligations under The Immigration, Asylum and Nationality Act 2006 resulting in the employment of three people who did not have the right to work in the United Kingdom. • Home Office Immigration Enforcement (“HOIE”) carried out a visit to Cherry Tree’s trading premises on 18 January 2025 and, following its investigation, the HOIE issued Cherry Tree with a Notice of Liability for a Civil Penalty on 07 March 2025 in the sum of £120,000 in respect of the employment of three workers, payment of which was due on or before 08 April 2025. • After consideration of an objection submitted by Mr Chiriac, received on 14 March 2025, the Civil Penalty was upheld, payment of which was due on or before 23 April 2025. • Cherry Tree did not pay the penalty due to HOIE which remained outstanding in full at liquidation. At Liquidation on 30 May 2025, Cherry Tree had liabilities of £137,098, of which £120,000 relates to the outstanding civil penalty. • Mr Chiriac was the appointed director of the company at the time of the breach of the Immigration, Asylum and Nationality legislation.
