Conduct: Mr Marveen St’Clair Brown (“Mr Brown”) whilst appointed as the sole director of Disco Retail Limited (“Disco Retail”) from 20 March 2019 (the incorporation date) to 18 January 2021 (the date of liquidation) failed to ensure that Disco Retail maintained and/or preserved adequate accounting records, or in the alternative, has failed to deliver up such records to the liquidator, therefore it has not been possible to: Verify in the absence of any sales documentation that the total amount credited to the company bank account of £338,552.15 during the period 3 May 2019 to the 18 December 2020 was legitimate company sales income Verify the debits from the company bank account totalling £339,566.19 during the period 3 May 2019 to 18 December 2020 and whether the payments were made in respect of legitimate company expenditure Verify the annual turnover figure of £410,000 stated in the Bounce Back Loan application of the 6 May 2020 and whether Disco Retail was therefore eligible for the maximum 25% Bounce Back Loan (BBL) amount of £50,000 Determine the economic benefit Disco Retail had from the £50,000 BBL deposited into the company bank account on 7 May 2020. Quantify the true asset and liability position as Disco Retail entered liquidation on 18 January 2021 with no declared assets, and liabilities as regards creditors of £79,693.28.
