Conduct: On 06 September 2020, Sabine Zogota (“Ms Zogota”) caused Bespoke Surrey Limited (“BSL”) to breach the conditions of the Bounce Back Loan (“BBL”) Scheme by applying for the loan when the company was not eligible in that; The BBL eligibility criteria allowed a business to borrow between £2,000 and up to 25% of the company turnover (up to a maximum of a £50,000 loan) figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover. The applicant had to have been carrying on business on 01 March 2020. BSL was incorporated on 18 March 2019. On 06 September 2020 a BBL application was submitted on behalf of BSL which contained Ms Zogota’s printed name and electronic signature declaring that the company’s turnover was £200,000. BSL’s end of year accounts for periods ended 31 March 2020 and 2021 show that the company was dormant. BSL’s bank statements show that prior to the BBL, no trade had taken place and there is no evidence to suggest that the company was carrying on business as at 01 March 2020 as per the terms of the BBL scheme . On 08 September 2020 BSL received the BBL funds of £50,000. Between 09 September 2020 and 11 August 2022 the BBL funds were dispersed and there is no evidence that this was to the economic benefit of the company. At liquidation £48,171 remains outstanding in respect to the BBL.
