Conduct: On or around the 15 May 2020, Mr Shane Hadaway (“Mr Hadaway”) caused STH Flooring Supplies LTD (“STHFS”) to apply for a government backed Bounce Back Loan (“BBL”) of £50,000 when he knew, or ought to have known, that the company was not eligible for the BBL scheme, in that: • Under the BBL scheme, businesses were able to apply for a BBL if they were carrying on business on 1 March 2020, engaged in trading or commercial activity in the UK on the date of the BBL application and had been adversely impacted by Coronavirus. • STHFS was incorporated at Companies House on 07 March 2019. • Mr Hadaway was appointed the sole director of STHFS on 07 March 2019. • STHFS filed dormant annual accounts with Companies House for the financial year ending 31 March 2020. • On, or around, 15 May 2020 Mr Hadaway applied for a BBL of £50,000, the maximum amount available under the BBL scheme, on behalf of STHFS, stating an annual turnover figure for 2019 of £245,000. • STHFS opened a bank account on 11 March 2019 and there is no trading income seen in the account prior to receipt of the BBL. • There is no evidence to support the fact that STHFS was carrying on its business on 01 March 2020, or that it was trading or engaged in commercial activity on the date of the BBL application meaning it was ineligible for the BBL scheme. Furthermore, Mr Hadaway has failed to use the BBL obtained by STHFS for the economic benefit of the company, in that: • The terms of the BBL scheme stated that the BBL was to be used only for the economic benefit of the business, used wholly for business purposes and not personal purposes. • The bank balance prior to receipt of the BBL was £0. • After receipt of the £50,000 BBL on 15 May 2020, 5 payments of £10,000 were made to a third-party individual. • Of the £50,000 in payments made to the third-party individual, the full £50,000 came from BBL funds. • The payments detailed above were not for the economic benefit of STHFS and were contrary to the terms of the BBL scheme. • STHFS was wound up by Court Order on 28 August 2024. • At liquidation, STHFS had liabilities totalling £49,893.67 of which £49,893.67 was owed to the bank in respect of the BBL.
