Conduct: Abdul Basit Daoud (“Mr Daoud”) caused Devonport Restaurant Ltd (“Devonport”) to breach the conditions of the Bounce Back Loan Scheme (“BBL”) by applying for a BBL of £50,000, which he knew or ought to have known the company was not eligible for. In that: • The terms & conditions (‘T&Cs’) of the BBL scheme required BBL applicants to state their annual turnover for the 2019 calendar year or, if the applicant company was incorporated on or after 01 January 2019, an estimated annual turnover starting from the first date the applicant started their business; • The T&Cs stated that an applicant could request a BBL of 25% of the stated turnover subject to being an amount in between £2,000 and £50,000; • A business was eligible to apply for the loan if it was established and operating before 1 March 2020; • The accounts filed for the year ended 28 February 2020 indicate the company was not trading and thus Devonport was not eligible to borrow any monies; • The first recorded transaction in the company’s bank account was 29 July 2020; • On 30 September 2020, Mr Daoud signed a BBL agreement with the company’s bankers for £50,000 on Davenport’s behalf stating that the company’s annual turnover was £240,000; • On 1 October 2020, BBL funds of £50,000 were paid into Devonport’s bank account; • At the date of the Liquidation on 14 July 2022, a total of £76,733 was owed to creditors, of which £50,000 was in respect of the BBL.
