Conduct: On 30 September 2020 Mr Samuel Conway (“Mr Conway”) caused Nova Building And Developments Ltd (“NOVA”) to breach the conditions of the Bounce Back Loan ("BBL") facility by applying for a BBL of £50,000 from Bank B on 30 September 2020 when he knew or ought to have known that NOVA was not entitled to the loan having previously applied for and received a BBL of £50,000 from Bank A on 24 June 2020. Consequently, NOVA received more money than it was entitled to from the BBL scheme. In that: ? • Under the BBL scheme, businesses were able to apply for up to 25% of their turnover to a maximum of £50,000. Businesses which originally borrowed less than the maximum amount available to them under the Scheme were eligible to top-up their original loan, however the total loan amount was not to exceed 25% of the business’s turnover. Only one loan was available to businesses.?? • The terms of the BBL also stated that its intended purpose was to provide economic benefit to the business and not for personal purposes. ? • Mr Conway made an application for a BBL to Bank A of £50,000 on behalf of NOVA on 23 June 2020. The BBL funds were paid into Mr Conway’s personal bank account on 24 June 2020.? ? • Mr Conway made a further BBL application to Bank B for £50,000 on behalf of NOVA on 30 September 2020.?? ? • Mr Conway signed the declaration on the application form and BBL agreement on 30 September 2020 confirming that NOVA was eligible to benefit from credit facilities under the BBL scheme. The funds were paid into the Company’s bank account 57137975 with sort code 60-83-71 on 1 October 2020. • Between 23 October 2020 and 26 April 2021, payments were made from the company’s Bank B account to Samuel Conway referenced “Money” totalling £44,639, funded from the BBL monies. • Total liabilities at liquidation/administration amount to £292,257 of which £96,000 relates to amounts owed in respect of the 2 BBLs.??
