Conduct: On 06 October 2020, Billy Keith Whitrod (“Mr Whitrod”) caused Lux Sofas London Ltd (“Lux Sofas”) to apply for a Bounce Back Loan (“BBL”) of £50,000 at a time when he knew, or ought to have known, that Lux Sofas was ineligible to apply for the funds as it was not trading before 01 March 2020, resulting in Lux Sofas obtaining a BBL of £50,000 that it was not entitled to; in that: • The BBL Scheme terms and conditions state that applicants applying for a BBL on behalf of the business are required to declare that the business had been carrying on business on 01 March 2020 and had been adversely affected by the coronavirus pandemic; • Lux Sofas was incorporated on 18 February 2019; • Lux Sofas filed dormant accounts for year end 27 February 2020, and no further financial accounts were filed; • Lux Sofas’ bank account was not opened until 25 June 2020, and there were no transactions prior to the BBL application; • On 06 October 2020, Lux Sofas obtained a BBL of £50,000 with Mr Whitrod declaring that Lux Sofas had been carrying on business before 01 March 2020; • There is no evidence of turnover in the bank statements. The only credits into the account relate to the BBL. • Lux Sofas was placed into Creditors Voluntary Liquidation on 07 March 2023. • Total liabilities at liquidation amount to £52,253 of which £51,153 relates to the amount owed in respect of the BBL.
