Conduct: On 15 September 2020, Dominic John Skerratt (“Mr Skerratt”) caused Elite Student Lets Limited (“Elite”) to apply for a Bounce Back Loan (“BBL”) of £50,000 with an overstated turnover figure of £200,000 when he knew or ought to have known that Elite was not eligible for the scheme. In that: • The BBL Scheme allowed a business that was established before 01 March 2020 to borrow between £2,000 and a maximum of £50,000 based on 25% of its annual turnover in the calendar year 2019. • Under the terms of a BBL, where a business was established after 01 January 2019 an estimated figure for the turnover could be used. • Elite was incorporated on 12 February 2019, so by the date of Mr Skerratt’s application on 15 September 2020, had more than a full year of turnover beginning in 2019. • On 16 June 2020 Mr Skerratt approved year end accounts to be filed at Companies House for the period 12 February 2019 to 28 February 2020. The full version of these accounts show that Elite’s turnover was nil, and other operating income was £2,135. • In the BBL application for Elite, the turnover disclosed for the 2019 calendar year was £200,000. • Elite was not eligible for a BBL as the minimum required 2019 turnover to be eligible for the scheme was £8,000 for the minimum loan of £2,000. • On 08 November a petition to wind up Elite was presented by creditors, and on 15 January 2025 Elite was subject to a winding up order. At liquidation Elite’s deficiency was £262,684, of which £30,291 related to the BBL.
