Conduct: On 09 June 2020, I caused or allowed New Age Development Group Ltd (‘’NADGL’’) to apply for a Bounce Back Loan (‘’BBL’’) of £50,000 when I knew or ought to have known that NADGL was not eligible for a BBL, in that: ? Under the BBL scheme business were eligible to apply for a loan between £2,000 and £50,000 subject to a maximum of 25% of turnover if it was both carrying on its business on 01 March 2020 and was engaged in trading over commercial activity as at the date of the application. If eligible the turnover figure was self-certified by the applicant. The figure required was turnover for the calendar year 2019 or, where a business was established after 01 January 2019, the estimated turnover for the 12 months after the business was started. ? I was appointed as a director on 25 January 2020. ? In the BBL application on 09 June 2020, my co-director declared that the Company was carrying on business on 01 March 2020, and that the Company was engaged in trading or commercial activity in the United Kingdom as at the date of the BBL application on 09 June 2020. ? NADGL opened a bank account on 26 June 2019. The business bank statements show no incoming payments from this date until the date the BBL was received, so NADGL was not eligible for a BBL under the terms of the scheme. ? No evidence has been provided to support that NADGL was carrying on business on 01 March 2020, engaged in business or trading activity in the UK on 09 June 2020 ? NADGL was incorporated on Companies House 11 February 2019, consequently, if eligible to apply for a BBL, NADGL was entitled to use turnover for the 12 month period after business was started to calculate the maximum loan available. An estimate could be used. ? On 09 June 2020 my co-director applied for a BBL of £50,000 on behalf of NADGL. On the BBL application he stated the turnover for NADGL was £210,000. ? BBL funds of £50,000 were drawn down into NADGL’s bank account 10 June 2020. The bank statements show that whilst the account was opened on 26 June 2019, there had been no incoming payments to the account prior to receipt of the BBL funds. ? No evidence has been provided to support the turnover figure of £210,000. ? Total liabilities at liquidation amount to £537,234.21 of which £50,873.08 relates to the amount owed in respect of the BBL.
