Conduct: On 28 August 2020, John Michael Driver (“Mr Driver”) caused JMP (Crossroads) Ltd (“JMP”) to apply for a Bounce Back Loan (“BBL”) of £50,000, using overstated turnover figures, which resulted in JMP obtaining a BBL that was £29,388 more than it was entitled to. In that: Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover. JMP was incorporated on 11 February 2019. On 28 August 2020 Mr Driver applied for a BBL of £50,000 on behalf of JMP, declaring that its turnover for the calendar year 2019 was £2,000,000 (JMP was required to have a turnover of at least £200,000 in order to qualify to a BBL of £50,000). Accounts for period ended 28 February 2020 disclose turnover of £82,448. JMP received the BBL funds of £50,000 on 2 September 2020. Total liabilities at liquidation/administration amount to £70,462 of which £49,859 relates to the amount owed in respect of the BBL.
