Conduct: 1. On 19 September 2020 Christopher O’Connor (“Mr O’Connor”) caused HSR Construction Limited (“HSR”) to apply for a government-backed Bounce Back Loan (‘BBL’) of £50,000 which Mr O’Connor knew or ought to have known HSR was not eligible for. In that: • The BBL scheme permitted a loan of up to 25% of a business’ turnover in the calendar year 2019 (or estimated annual turnover from the date it commenced trading if it had been established after 01 January 2019), from £2,000 to a maximum of £50,000. • The further conditions of applying for a BBL were that a business had been carrying on its business on 01 March 2020 and engaged in trading or engaged in commercial activity in the United Kingdom at the date of the BBL application. • HSR was incorporated on 6 February 2019. • On 19 September 2020 Mr O’Connor applied to HSR’s Bank for a BBL of £50,000 self-certifying a turnover of £240,000. • HSR accounts to 28 February 2020 show it was dormant, and Mr O’Connor has not produced any evidence to support that HSR was carrying on business on 1 March 2020. • Mr Oconnor stated that the company commenced trading April 2021. • HSR was, therefore, not entitled to obtain a BBL given it was not carrying on business on 1 March 2020 or engaged in trading or commercial activity at the date of the BBL. • The bank has claimed £44.501.18 in the liquidation. 2. Christopher O’Connor contravened Section 13 of the Company Directors Disqualification Act 1986 by acting as a director of HSR Construction Limited (“HSR”), without leave of the Court between 29 March 2022 and its liquidation on 16 October 2023, while he remained subject to a disqualification undertaking.
