Conduct: On 12 May 2020, Fation Lushi (“Mr Lushi”) caused R.F Lushi Construction Ltd (“RFLC”) to obtain a £50,000 Bounce Back Loan (“BBL”), and failed to use it in its entirety for the economic benefit of RFLC, in breach the Terms and Conditions of the BBL Scheme, in that: Under the BBL scheme, businesses could apply for a loan of between £2,000 and £50,000. The purpose of the loan was to provide economic benefit to the business. RFLC was incorporated on 24 January 2019, and started trading during May 2019. On 12 May 2020, Mr Lushi submitted an application to obtain a £50,000 BBL on behalf of RFLC. The BBL funds were credited into RFLC’s bank account on 13 May 2020. On the same day, a payment of £49,950 was made to Mr Lushi’s personal bank account On 29 March 2022, RFLC entered liquidation with liabilities totalling £54,791.25 of which £50,188.53 relates to the amount owed in respect of the BBL.
