Conduct: On 8 May 2020 Mr Asim Mohammed Azam (“Mr Azam”) caused TRS Industrial Ltd (“TRS”) previously known as A.T Steelwork Specialists Ltd, to falsely apply for a Bounce Back Loan (“BBL”) of £50,000, at a time when he knew, or ought to have known, that the company was not eligible for the loan. In that: • Under the BBL scheme, businesses were able to apply for a BBL if they were engaged in trading or commercial activity in the UK at the date of the application, were carrying on business on 01 March 2020 and had been adversely affected by Covid. The funds were also to be used for the economic benefit of the business and not for personal purposes. • TRS was incorporated on 23 January 2019 and was registered for VAT with effect from 08 February 2019. • The VAT returns covering the period 08 February 2019 to 16 October 2020 all declared nil sales and nil purchases. • The only recorded transactions on TRS’ bank account prior to May 2020 were a transfer into the account from Mr Azam for £8 on 18 October 2019 and two bank charges of £7.50 in March and April 2020. • On 8 May 2020, TRS applied for a BBL of £50,000. The BBL funds were paid into TRS’ bank account on 11 May 2020. • Mr Azam has failed to provide any evidence to demonstrate that the company was trading at the relevant times in order for TRS to be eligible for a BBL, and therefore it is unlikely the BBL has been used for the economic benefit of the company. • TRS was dissolved on 09 November 2021 owing £50,000 to the bank in respect of the BBL.
