Conduct: On 26 May 2020 Mr Mohammad Sayedur Rahman (“Mr Rahman”) caused SAFEKEEPING GROUP LTD (“Safekeeping”) to apply for a Bounce Back Loan (“BBL”) of £50,000 using an overstated turnover figure, which resulted in Safekeeping obtaining a BBL that was greater than it was entitled to, in that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover. • Furthermore, the BBL application, signed by Mr Rahman, specified “If your business was established after 1 January 2019, you should apply the 25% limit to your estimated annual turnover from the date you started your business” • Safekeeping was incorporated on 02 January 2019. • On 26 May 2020, Mr Rahman applied for a BBL of £50,000 on behalf of Safekeeping declaring that its estimated turnover for the calendar year 2019 was £238,000. • Whilst Mr Rahman was permitted to estimate the turnover of the business in the BBL application, bank statements for the period 02 January 2019 to 01 January 2020 show total incoming payments of £7,805 which were available to Mr Rahman at the date of applying which would entitle Safekeeping to a BBL of below the £2,000 minimal limit. • As such, Mr Rahman knew or ought to have known that the turnover figure of £238,000 was overstated when the BBL application was made. • Safekeeping received the BBL funds of £50,000 on 29 May 2020 • Total liabilities at liquidation amount to £64,109 of which £50,362 relates to the amount owed in respect of the BBL.
