Conduct: Mr Sazzadur Rahman (“Mr Rahman”) caused Beys Diner Ltd (“Beys”) to apply for a Bounce Back Loan (“BBL”) of £50,000 using overstated turnover figures, which resulted in Beys obtaining a BBL that was at least £41,336 more than it was entitled to. Mr Rahman has failed to provide evidence that £49,000 of the BBL funds were used for the economic benefit of the business, in that: Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover for the calendar year 2019. The turnover figure was self-certified by the applicant and the BBL funds could only be used to provide an economic benefit to the business and not be used for personal benefit. Beys was incorporated on 7 December 2018 and began trading during January 2019. On or around 27 October 2020, Mr Rahman applied for a BBL of £50,000 on behalf of Beys declaring that its estimated turnover for the calendar year 2019 was £200,000. Beys’ Accounts for the year ended 31 December 2019 (approved by the board on 15 September 2020 and signed on its behalf by Mr Rahman) disclose turnover of £34,659. Beys’ company tax return for the year ended 31 December 2019 (filed on 19 September 2020) discloses turnover of £32,438. On 27 October 2020, a BBL of £50,000 was paid into Beys’ company bank account. between 30 October 2020 and 4 November 2020, £49,000 was transferred from the company bank account to ‘S Rahman My HSBC’. No documentary evidence to show that these payments were to provide an economic benefit to the business has been provided. Total liabilities at liquidation amount to £101,501, of which £50,000 relates to the amount owed in respect of the BBL.
