Conduct: On 19 June 2020 Mr Mohammed Zaheer (Mr Zaheer) caused Aakash Balti Knaresborough Limited (Aakash) to breach the conditions of the Bounce Back Loan ("BBL") facility by applying for two BBL’s each of £50,000 when he knew or ought to have known that Aakash was not entitled to, in that: Under the BBL scheme businesses were able to apply for up to 25% of their turnover to a maximum of £50,000. Businesses which originally borrowed less than the maximum amount available to them under the Scheme were eligible to top-up their original loan, however the total loan amount was not to exceed 25% of the business’s turnover. Only one loan was available to businesses.?? On 19 June 2020 Mr Zaheer made an application with Bank A for a BBL of £50,000 on behalf of Aakash. The BBL funds were paid into Aakash’s bank account held with Bank A on 22 June 2020. On 19 June 2020 Mr Zaheer made a further application with Bank B for a BBL of £50,000 on behalf of Aakash. The BBL funds were paid into Aakash’s bank account held with Bank B on 23 June 2020. The BBL terms and conditions required the applicant to self-declare that they had not made any other application for a BBL for the business. Mr Zaheer knew or ought to have known that Aakash was not entitled to the second BBL when the second application for the BBL was made and the funds were received. Aakash entered Creditors Voluntary Liquidation on 11 May 2023. At liquidation, Aakash had liabilities of £188,680, of which £38,981 was owed in respect of the BBL to Bank A. This does not include £38,672 owed to Bank B in respect of the further BBL as Mr Zaheer failed to disclose this to the liquidator of Aakash.
