Conduct: On 29 May 2020 Chinedu Onyekwulu (“Mr Onyekwulu“) caused VL Fashion Ltd to apply for a Bounce Back Loan (“BBL”) of £50,000 using overstated turnover figures, which resulted in VL Fashions obtaining a BBL to which he knew, or ought to have known, that VL Fashions Ltd was not entitled to. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover from when the company started. • VL Fashion Ltd was incorporated on 27 November 2018 and according to Mr Onyekwulu began trading a couple of months after incorporation. • On 20 May Mr Onyekwulu approved the annual accounts for the period 27 November 2018 to 30 November 2019. • VL Fashion Ltd’s Year End accounts for the period 30 November 2020 show turnover for 2019 of £6,640. • Bank statements for the period 26 November 2019 to 24 February 2020 do not show any income received between 26 November and 31 December 2019. • On 29 May 2020, Mr Onyekwulu applied for a BBL of £50,000 on behalf of VL Fashion, declaring a turnover of £250,000. • VL Fashion Ltd received the BBL funds of £50,000 on 01 June 2020. • VL Fashion Ltd was not eligible to apply for a BBL, as it did not meet the turnover of £8,000 to qualify for the minimum £2,000 loan. • VL Fashion Ltd entered Creditors’ Voluntary Liquidation on 24 April 2024. • Total liabilities at liquidation amount to £44,802 of which £40,000 relates to the amount owed in respect of the BBL.
