Conduct: Sivanesaselvan Rasalingam (“Mr Rasalingam”) caused Eagle Parking Limited (“Eagle”) to apply for a government-backed Bounce Back Loan (“BBL”) of £50,000 and following receipt of the BBL on 23 July 2020, he failed to use the money in compliance with the terms of the scheme, in particular for the economic benefit of the business. In that: • Eagle was incorporated on 26 November 2018 and began trading on 19 April 2019. Mr Rasalingam was appointed as sole director on 26 November 2018 and remained so until the Company entered liquidation on 22 November 2022. • On 22 July 2020, Mr Rasalingam, on behalf of Eagle, applied for a BBL of £50,000 from a Bank and the funds were received on 23 July 2020. • The BBL agreement signed by Mr Rasalingam stated, “You will only use the loan we provide under this loan agreement for the purpose of providing economic benefit to your business including, but not limited to, working capital or investing in your business and to support trading or commercial activity in the United Kingdom….” • The balance on Eagle’s bank account prior to receipt of the BBL was £7.03. • Following receipt of the BBL funds on 23 July 2020 in the period from 24 July 2020 to 28 July 2020 five payments totalling £49,000 were made from Eagle’s bank account to Mr Rasalingam’s personal bank account. • No evidence has been provided that these payments were used for the economic benefit of the Company in accordance with the BBL scheme. • The bank is a creditor in the liquidation for £47,774.23 in respect of the BBL.
