Conduct: On 12 June 2020, Mr Andrew William Caldwell (“Mr Caldwell”) caused I.C.E. Events Hampshire Limited (“I.C.E”) to falsely apply for a Bounce Back Loan ("BBL") of £50,000 and used at least £47,920 for his personal benefit, when he knew or ought to have known that I.C.E was not eligible for the loan, in that: • The terms of the BBL state that the business must be engaged in trading or commercial activity in the UK at the date of the application, was carrying on business on 1 March 2020 and has been adversely affected by coronavirus (COVID-19). • On 12 February 2020, I.C.E was put on notice by its landlord that it was to vacate its trading premises by 16 April 2020. • No trading income is paid into the company bank account after 25 March 2020 • On 12 June 2020, Mr Caldwell caused I.C.E to apply for a BBL of £50,000, which was credited into its business bank account on 15 June 2020. • On the same date, £50,000 was transferred from I.C.E’s business bank account to its business savings account. • Between 15 June to 12 October 2020, £47,920 was paid out of I.C.E’s business savings account to Mr Caldwell’s personal bank account. • At liquidation, the BBL of £50,000 remains outstanding.
