In that: • BLL was incorporated on 05 November 2018 and, according to Mr Borowka, commenced trading that same month. • Mr Borowka was a director of BLL throughout. • BLL first filed trading accounts for the year ended 30 November 2019 and, thereafter, to that date in in each of the years from 2020 to 2022. • The unabridged versions of the accounts for the years ended 30 November 2019 and 2020 show, respectively, turnover of £30,641 and £35,134. • BLL’s banking records show that the account was opened on 16 November 2018 and that the first transaction occurred on 14 December 2018. • As it was trading prior to January 2019 BLL was required to provide its actual income, in the calendar year 2019, on the BBL application. • Bank statements for the calendar year 2019 show gross receipts of £32,934.71. • Based on those receipts received into its bank account during the calendar year 2019, BLL was entitled to a BBL of no more than £8,234. • On 29 May 2020, Mr Borowka applied for a BBL, stating that the Company’s turnover was £200,000 and requesting a loan of £50,000. • The BBL, in the amount of £50,000, was received into BLL’s account on 02 June 2020. • BLL made fourteen instalment payments, totalling £7,850, on the BBL. • At the liquidation date £43,954.01 remained outstanding in respect of the BBL.
