Conduct: On 6 May 2020 James Shea (“Mr Shea”) caused Go Ninja Limited (“GNL”) to apply for a Bounce Back Loan (BBL) of £50,000 using overstated turnover figures in the application form when he knew or ought to have known that GNL was not entitled to a BBL of this amount, in that: • A business could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25%of turnover in calendar year 2019. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019 it was their estimated annual turnover from the date the business started. The turnover figure was self-certified by the applicant • GNL was incorporated on 31 October 2018. • Mr Shea applied for a BBL of £50,000 on 6 May 2020 and stated the annual turnover for GNL was £229,889. • On 11 May 2020 the BBL of £50,000 was deposited into the company bank account of GNL. • The company accounts for the Year Ended 31 October 2020, disclose company turnover for Year Ended 31 October 2019 of £39,009 and Year Ended 31 October 2020 of £32,809. • Based on the accounts Year Ended 31 October 2019, the company was eligible to apply for a BBL of no more than £9,752. • On 16 September 2024, GNL entered Liquidation with known liabilities of £44,017 which is owed in respect of the BBL.
