Conduct: Renaldo Bothma (“Mr Bothma”) caused Botthms LTD (“Botthms”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme on 20 August 2020 by using overstated turnover figures in the BBL application form and on 09 September 2020 by applying for a second BBL of £20,000 when he knew or ought to have known that Botthms was not entitled to the loan having previously applied for and received a BBL of £50,000 on 21 August 2020, in that: • Under the BBL scheme businesses were able to apply for a single BBL up to 25% of their turnover to a maximum of £50,000. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019. • Businesses which originally borrowed less than the maximum amount available to them under the Scheme were eligible to top-up their original loan, with their existing lender. However, the total loan amount was not to exceed 25% of the business’s turnover or £50,000. • Botthms was incorporated on 30 October 2018. • Banking records show Botthms turnover for YE 31 December 2019 was £82,163. • Mr Bothma made an application for a BBL of £50,000 from Bank A on behalf of Botthms on 20 August 2020 stating Botthms turnover to be £200,000. • The £50,000 BBL funds were paid into Botthms Bank account A on 21 August 2020. • Based on Botthms turnover for the calendar year 2019 the amount of BBL that Mr Bothma could have applied for on behalf of Botthms was, at most £20,541. Therefore, Botthms received £29,459 more than it was entitled to, from Bank A, under the BBL scheme. • Mr Bothma made a second BBL application of £20,000 from Bank B on behalf of Botthms on 09 September 2020 and signed the declaration confirming that “this is my only application for a BBL for this business” • The £20,000 from Botthms second application was paid into Botthms Bank account B on 15 September 2020. • Under the terms and conditions of the BBL scheme Botthms was entitled to apply for a single BBL. Botthms applied for and received two BBLs totalling £70,000 and in so doing received £49,459 more than it was entitled from the BBL scheme. • On 18 January 2024 Botthms entered Creditors Voluntary Liquidation with total liabilities of £184,443 of which £65,000 relates to the outstanding BBL’s.
