Conduct: On 12 February 2021 Marco Paulo Goncalves De Aveiro (“Mr Aveiro”) caused Living Constructions Ltd (“LC”) to provide misleading information to a bank to obtain a Bounce Back Loan (“BBL”) of £50,000 when he knew or ought to have known that “LC” was not eligible for a loan of that amount. In that: • Mr Aveiro was a joint director of “LC” from incorporation on 29 October 2018. • Mr Aveiro had full authority on the bank mandate for the company bank account • “BBL”s were limited to 25% of 2019 calendar year turnover. • Accounts for Year Ending 31 October 2019 show turnover was £68,322 and Mr Aveiro signed and approved those accounts on 21 October 2020. • For the remainder of the 2019 calendar year (November and December 2019) LC's bank statements show deposits attributable to turnover to be £34,729. Therefore LC's turnover in the calendar year 2019 was £103,051 meaning that it was eligible for a BBL of no more than £25,763. • In the BBL application dated 12 February 2021, a turnover of £500,000 was declared, when I knew, or ought to have known, that this was incorrect. • Bank statements confirm receipt of a BBL of £50,000 on 16 February 2021. • By providing misleading information, LC obtained a BBL of £50,000 which is at least £24,237 in excess of the BBL amount that it was eligible for. • At the time of Liquidation, the BBL had not been repaid and creditors are owed a total£83,410, including the BBL of £50,000.

Therefore LC's turnover in the calendar year 2019 was £103,051 meaning that it was eligible for a BBL of no more than £25,763. • In the BBL application dated 12 February 2021, I either caused or allowed a turnover figure of £500,000 to be declared by Mr Aveiro when I knew or ought to have known that this was incorrect. • Bank statements confirm receipt of a BBL of £50,000 on 16 February 2021. • By providing misleading information, LC obtained a BBL of £50,000, at least £24,237 in excess of the BBL amount that it was eligible for. • Creditors at liquidation total £83,410, including the BBL of £50,000.
