Conduct: Mr Ademilson Nascimento (“Mr Nascimento”) caused Buildan Construction Ltd (“BCL”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by applying for a BBL when he knew or ought to have known that BCL was not eligible for the scheme. In addition, Mr Nascimento caused BCL to expend all BBL funds for purposes that did not provide economic benefit to the company, in breach of the BBL terms and conditions, in that: • Under the BBL scheme an applicant was required to confirm that the business was engaged in trading or commercial activity in the UK at the date of the application and was carrying on business on 1 March 2020. • BCL was incorporated on 29 October 2018. • BCL filed dormant accounts for the Years Ended 31 October 2019, 31 October 2020 and 31 October 2021. • BCL’s report to creditors, signed by Mr Nascimento, states that the company never traded. • On 29 June 2020, Mr Nascimento applied for a BBL of £46,500 on behalf of BCL declaring a turnover of £192,000. • On 21 July 2020, £46,500 was credited to the bank account used by BCL. • Based on the dormant accounts filed. BCL was not eligible to apply for a BBL and in doing so received £46,500 more than it was entitled to from the scheme. • The terms of the BBL scheme stated that the BBL was to be used only for the economic benefit of the business, used wholly for business purposes and not personal purposes. • BCL never traded and there is no evidence that the BBL funds were used for the economic benefit of the company. • At the date of the liquidation on 04 April 2023, total liabilities amounted to £40,396 of which £40,096 was in respect of the BBL.
