Conduct: On 22 May 2020, Mr Ajaib Singh Gurpreet Singh (‘’Mr Singh’’) caused J&M PROVISIONS PVT LTD ("JMP") to wrongfully apply for a second Bounced Back Loan (“BBL”) of £50,000 contrary to the terms and conditions of the BBL scheme when he knew or ought to have known that it was not entitled to so as only one BBL was permissible. In that: • The BBL scheme allowed businesses affected by the Coronavirus pandemic to apply for one government backed loan of 25% of turnover in the calendar year 2019, up to a maximum of £50,000. • Guidance available on the British Business Bank website, as at 5 May 2020, confirmed that, in order to be eligible to apply for a BBL, borrowers were required to be able to declare that “The business (and any wider group of which it is part) is not in the process of applying for or has not already received a Bounce Back Loan Scheme facility” • On 5 May 2020 Mr Singh submitted an application form to Bank A in which JMP sought a BBL of £50,000. • On or around 22 May 2020, Mr Singh submitted an application form to Bank B in which JMP sought a BBL of £50,000 and which contained a declaration which confirmed that this was the only application for a BBL that had been made on behalf of JMP. • On 22 May 2020 JMP received a BBL of £50,000 from Bank B. • On 5 June 2020 JMP received a BBL of £50,000 from Bank A. • JMP entered company voluntary liquidation on 23 September 2024 with a balance owed to Bank A in respect of the BBL of £36,579 and a balance owed to bank B in respect of the BBL of £36,806
