Conduct: Abdulgafur Ussenmia (“Mr Ussenmia”) caused Rafiya Limited (“Rafiya”) to breach the terms & conditions of the Bounce Back Loan (“BBL”) scheme by applying for a BBL of £50,000 on 23 November 2020 by overstating turnover on the application form. Consequently, Rafiya received monies it was not entitled to from the BBL scheme, in that: • The Bounce Back Loan (“BBL”) criteria allowed a company to borrow between £2,000 and a maximum of £50,000 based on 25% of the company’s turnover. The turnover figure required was that for the calendar year 2019. • On 23 November 2020 Rafiya received a Bounce Back Loan (“BBL”) of £50,000. • To obtain a BBL of £50,000 the turnover for the 2019 calendar year in the BBL application completed by Mr Ussenmia was stated to be £200,000. • The accounts for the year ending 31 October 2019 show a turnover figure of £16,081, the income paid into the company bank account between 01 November 2019 and 31 December 2019 was £7,885, therefore the turnover for 2019 was at most £23,966. • On the basis of a turnover of £23,966 Rafiya would have been eligible for a BBL of £5,991. By overstating turnover, Mr Ussenmia caused Rafiya to receive £44,009 more than it was entitled to. • On 29 June 2022 Rafiya entered into liquidation with liabilities of £54,237, of which £50,000 was in respect of the BBL.
