Conduct: On 26 May 2020 Lorela Xhebexhiu (“Ms Xhebexhiu”) caused Ester Auto Care Garage Ltd (“Ester”) to apply for a £50,000 government backed Bounce Back Loan (“BBL”), an amount to which it was not fully entitled by overstating its turnover which she knew or ought to have known was inaccurate. In that; • Under the BBL scheme, businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of its turnover for the calendar year 2019. The turnover figure was self-certified by the applicant. • Ester was incorporated on 26 September 2018 and started trading on the same date. • Ms Xhebexhiu applied for a BBL on 26 May 2020 of £50,000 on behalf of Ester, and she declared an annual turnover for 2019 of £200,000 in the application. • The £50,000 BBL was paid into the company bank account on 28 May 2020. • Full accounts for the company for the period ended 30 September 2019 show that the annual turnover of the company was £71,760. • Full accounts for the company for the period ended 30 September 2020 show that the annual turnover of the company was £72,507. • By overstating the company’s turnover on its application for a BBL, Ms Xhebexhiu caused Ester to obtain a larger BBL than it was entitled to. • At liquidation on 31 January 2025 £34,261 of the £50,000 BBL remained outstanding.
