Conduct: On 11 May 2020, Mr Dong Me He (“Mr He”) caused Ace Game Ltd (“Ace”) to apply for a Bounce Back Loan (“BBL”) of £37,500 using overstated turnover figures, which resulted in Ace obtaining a BBL that was in excess of that to which it was entitled to. Further, the BBL was not used in its entirety for the economic benefit of Ace, in that: • under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover for the calendar year 2019. The turnover figure was self-certified by the applicant and the BBL funds could only be used to provide an economic benefit to the business and not be used for personal benefit. • Ace was incorporated on 20 September 2018 and began trading during January 2019. • Mr He was appointed as sole director at the date of incorporation. • on 11 May 2020, Mr He applied for a BBL of £37,500 on behalf of Ace declaring that its estimated turnover for the calendar year 2019 was £150,000. • Ace’s Accounts for the year ended 31 September 2019 (approved by the board on 18 May 2020 and signed on its behalf by Mr He) disclose turnover of £60,813 for the 9 month period from January 2019 which would equate to an estimated yearly turnover of £81,084. • Ace received the BBL funds of £37,500 on 16 May 2020, which was at least £17,229 more than it was entitled to. • Between 18 May 2020 and 21 May 2020, 3 x £10,000 (totalling £30,000) was transferred from the company bank account to a third party but no evidence to show that these were to provide an economic benefit to the business has been provided. Of this amount at least £13,394 came from BBL funds. • Total liabilities at liquidation amount to £58,270 of which £37,500 relates to the amount owed in respect of the BBL.
