Conduct: On 11 May 2020, Mrs Frederique Giraud (“Mrs Giraud”) caused TFX Capital Ltd (“TFX”) to breach the terms and conditions of a Bounce Back Loan (“BBL”) by failing to ensure that the proceeds were used for the economic benefit of TFX, in that: • Mrs Giraud applied for a BBL of £50,000 on 04 May 2020 and declared that TFX would only use the funds “for business purposes and not personal purposes”. • Bank statements record that on 08 May 2020, TFX received the £50,000 BBL into its bank account, and on 11 May 2020 £59,000 was paid to the spouse of Mrs Giraud. Prior to the BBL deposit the bank account balance was £9,878, and £867 after the payment on 11 May 2020. • Between 08 May 2020 and 11 May 2020 no income was received by TFX. • Mrs Giraud has provided no evidence that the BBL was used for the economic benefit of TFX and their spouse has not repaid the £59,000 to TFX. • TFX entered compulsory liquidation on 21 June 2023 with liabilities of £558,104, which included £50,000 estimated to be owed to the BBL lender.
