Conduct: On 05 May 2020, Waseem Mohammed Banaras (“Mr Banaras”) caused Pizza Holdings Ltd (“PHL”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by overstating PHL’s turnover when applying for a BBL. As result PHL received a £50,000 BBL when Mr Banaras knew or ought to have known that PHL was not eligible for a BBL of that amount, in that: o Under the BBL scheme, businesses could apply for one loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019, or where a business was established after 01 January 2019, an estimated turnover could be used. o PHL was incorporated on 11 September 2018, started trading before 01 January 2019, and was therefore not entitled to estimate it’s turnover when applying for a BBL. o On 05 May 2020, Mr Banaras applied for a £50,000 BBL on behalf of PHL, declaring that its turnover for calendar year 2019 was £250,000. On the 11 May 2020, Mr Banaras signed the BBL agreement, and on 13 May 2020 BBL funds of £50,000 were credited into PHL’s bank account. o Accounts prepared by PHL’s accountants for the year ending 30 September 2020 show that PHL had a turnover of £98,406 during year ending 30 September 2019. o Analysis of its bank statements shows that between 01 January 2019 and 31 December 2019 PHL received credits totalling £90,744. o Based on the income received in its bank account during calendar year 2019, PHL was entitled to apply for a BBL of up to £ 22,686.01. o The overstatement of turnover meant that PHL received £27,313.99 more than it was entitled to from the BBL scheme. o On 15 January 2025, PHL entered Creditors’ Voluntary Liquidation with liabilities totalling £74,350, of which £41,042.57 was owed in respect of the BBL.
