Conduct: Mr Dominic Bacci (“Mr Bacci”) failed to ensure that Michael 1987 Ltd (“Michael 1987”) maintained and/or preserved adequate accounting records, or in the alternative, following liquidation failed to deliver up such records to the Liquidator when requested for the period from 01 October 2019, the date following last set of accounts, to 21 April 2022, the date of liquidation. As a result, it has not been possible to: Verify the total amount credited to the company bank account of at least £786,352 between 01 October 2019 to liquidation represents total legitimate income of the company. Verify the total amount debited from the company bank account of at least £783,556 between 01 October 2019 to liquidation represents total legitimate expenditure of the company. Establish the extent and nature of Mr Bacci’s remuneration from 01 October 2019 to liquidation. Establish whether payments totalling £59,993 to a third party were payments in the normal course of trade. Establish whether payments totalling £76,281 paid to a relative of the director and a former director of the company were payments in the normal course of trade. Establish whether payments totalling £68,882 to 3rd parties holding the same surname as the director were payments in the normal course of trade. Verify the true liability to HMRC as assessments were raised by HMRC for VAT periods ending 08/20 to liquidation as returns were not submitted. At Liquidation, HMRC made a claim totalling £62,621 which consists of PAYE £41,711, VAT £14,553, Corporation Tax £5,276 and surcharges, penalty charges and interest are included in the total claim. At liquidation, £66,278 was owed to creditors.
