Conduct: On 08 August 2020 Kevin Vincent Kelleher (“Mr Kelleher”) caused Hainault Business Services Ltd (“Hainault”) to apply for a Government backed Bounce Back Loan (“BBL”) totalling £50,000 that it was not eligible for in that: • The terms of the BBL scheme was that a Company was entitled to apply for one BBL (between £2,000 and £50,000) of up to 25% of its 2019 turnover under the BBL scheme. If the company was established after 01 January 2019 it was permitted to estimate its annual turnover from the date that it commenced trading. • Hainault was incorporated on 26 July 2018. • A bank account (no.1) was opened prior to 10 October 2018 . Between 10 October 2018 and 15 March 2019, the sum of £69,000 was received from an associated company. • On 10 April 2019 a credit of £10,000 was received from Mr Kelleher. Apart from a few refunds there were no further credits received into the account. • There were no further entries after 23 April 2019 except to cover account charges. • Dormant Accounts were filed at Companies House for the years ending 31 July 2019 and 31 July 2020. • Hainault was not eligible for a BBL of any amount as it was not trading as at 01 March 2020 • On or around 08 April 2020 Mr Kelleher opened a second account with the bank. • On 08 August 2020 Mr Kelleher applied to the bank for a BBL in the sum of £50,000 stating that the Company’s turnover was £300,000. • On 10 August 2020 the BBL of £50,000 was paid into Hainault’s bank account. • On 20 August 2020 the sum of £25,000 was paid to a third party company. The association with Hainault and Mr Kelleher is unknown. • Between 10 August and 28 September 2020 the sum of £9,833 was withdrawn in cash. • Between 25 August and 02 September 2020 cheques were issued to unknown parties totalling £5,950. • Between 10 August and 28 September 2020 payments were issued to unknown parties for £6,401. • Between 20 August and 16 September2020 payments were made totalling £3,942 for Mr Kelleher’s personal benefit. • On 07 December 2020 Mr Kelleher filed dormant accounts for the year ending 31 July 2020. • On 02 November 2021 Mr Kelleher filed dormant accounts for the year ending 31 July 2021. • No evidence has been provided to show that Hainault was eligible for the BBL or that the proceeds were used for Hainault’s economic benefit. • At Liquidation £50,000 remained outstanding in respect of the BBL obtained.
