Conduct: On 17 June 2020 Shirina Parvin Uddin Choudhury, (“Ms Choudhury”) allowed Suwad Limited (“Suwad”) to overstate the company’s turnover to obtain a £50,000 government backed Bounce Back Loan (“BBL”), when she knew or ought to have known that the company was not entitled a loan of that amount. As a result, Suwad obtained a BBL that was at least £42,008 more than it was entitled to. In that: • Under the BBL scheme, businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of its turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover. • Suwad was incorporated on 26 July 2018. • On 17 June 2020 a BBL of £50,000 was applied for on behalf of Suwad. The application form asked for the company’s annual turnover for the calendar year 2019. The figure given in answer to this question was £200,000. • The £50,000 BBL was paid into the company bank account on 13 July 2020. • Full company accounts are not available for Suwad, only micro entity accounts that do not show company turnover. However, credits into Suwad’s company bank account for the calendar year 2019 total £31,968. • As BBLs could be between £2,000 and £50,000, based on 25% of turnover for 2019, the maximum BBL Suwad was eligible for was £7,992. Therefore, Suwad obtained a BBL that was at least £42,008 more than it was entitled to. • At liquidation on the 25 August 2022, £43,053 of the £50,000 BBL remained outstanding.
