Conduct: Between 15 September 2022 and 5 December 2023, Leanne Richardson (“Ms Richardson”) failed to ensure ESL Consultancy Services Ltd (“ESL”) complied with Regulation 22 and Regulation 23 of The Privacy and Electronic Communications (EC Directive) Regulations 2003 (“PECR”) in that: • Between 15 September 2022 and 5 December 2023, ESL engaged a third party supplier to use public communication systems to instigate the transmission of unsolicited electronic mail to individual subscribers for direct marketing purposes, without verifying valid consent. ESL continued this arrangement despite clear evidence of non compliance, in contravention of Regulation 22 of the PECR. • The Information Commissioner’s Office (“ICO”) investigated ESL following 37,961 complaints via the ‘7726 SPAM’ reporting service and 16 complaints through the ICO Online Reporting Tool (“OLRT”). • The ICO determined that ESL failed to comply with Regulation 22 of PECR and further found a breach of Regulation 23 by ESL agreeing to the use of unregistered pre-pay SIM cards, thereby concealing the identity of the sender. • On 17 October 2024 the ICO issued ESL with a Notice of Intent (“NOI”) for multiple breaches of Regulation 22 and 23 of PECR. The proposed penalty was £200,000. • On 5 December 2024, The ICO issued a Monetary Penalty Notice (“MPN”) for the amount of £200,000. • On 2 January 2025 ESL submitted an appeal to the General Regulatory Chamber which it later withdrew. The MPN remained unpaid at the time of liquidation.
